R4S Aft facing seat issue

I have an r4s ordered new about a year ago. the seat back on the rear pad has 3 positions. forward facing, lie flat and aft facing. the mechanism to change it to lie flat is to pull the seatback port side which releases a pin that allows it to flop down onto the rear bench.

problem we are having is that this can inadvertently happen while in aft facing mode. while surfing or even lounging at anchor the normal wiggle of people seating in that position will allow the pin to eventually slip port and release causing those seated to drop rapidly into the lie flat position. It is quite jarring to the passengers.

I had cobalt (slalom Shop - dallas) look at this and they adjusted it but it seems no better and is getting worse.

Has anyone else seen this issue?
